What The Cove's governing documents say
The Cove is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). All lot owners are automatically members of the HOA and must follow these protective covenants, which cover architectural standards, land use, and assessments.
- Single-family use only: Each lot is restricted to single-family residential use only. No commercial activity is allowed, except that the developer may use a structure for sales purposes.
- Architectural review: All construction, landscaping, tree removal (trees 4 inches or larger in diameter), fences, bulkheads, and other improvements require prior written approval from the Architectural Control Committee (ACC). Plans must be submitted at least 30 days before starting work; if the ACC does not respond within 30 days, the plan is deemed approved. Appeals of denials go to the HOA Board and require a unanimous vote to override.
- Building size & design: Homes must have between 1,500 and 3,500 square feet of heated, enclosed living space, with no more than 2,000 square feet on any one level. No modular or pre-built homes are allowed; all homes must be constructed substantially on site. Maximum impervious ground coverage is 3,800 square feet unless approved by the ACC. Homes must be built on pilings and comply with stormwater regulations.
- Leasing & rentals: Leases or rentals for less than 60 continuous days are prohibited. Short-term rentals are not allowed.
- Parking & vehicles: Each lot must have at least three off-street parking spaces. Boat trailers, vans, travel trailers, and other oversized vehicles may be parked on the lot but not on street rights-of-way.
- Fences & signs: Fences require ACC approval and are generally not allowed along lot lines unless the owner shows an extraordinary need. Signs are heavily restricted: only small contractor signs (max 4 sq ft, removed after occupancy), owner identification signs (approved by ACC), for-sale signs (max 4 sq ft), and required governmental signs are permitted.
- Assessments & dues: Annual dues are $420, payable in two installments of $210 on January 1 and April 1. Special assessments may be levied by a 70% vote of owners, or by the Board in an emergency. Unpaid assessments become a lien on the lot and may be foreclosed.
- Nuisance & rules: Any activity deemed a nuisance by the Association is prohibited. The Association may impose fines of $100 per violation (per day for continuing violations) after written notice and a 30-day cure period. The Board may also adopt rules on pets, rentals, parking, and other matters.
