Ridgewood Heights is a single-family home subdivision in Wilmington, NC, governed by a 1959 Declaration of Restrictions. These covenants run with the land and bind all current and future lot owners.
- Residential use only: Lots may only be used for residential purposes. No commercial use, and no lot may be used as a public or private street except Lots 7 and 19.
- Building size & type: Only one detached single-family dwelling per lot, no more than two stories, plus a private garage for up to two cars. Minimum dwelling cost: $8,000; minimum floor area: 1,000 square feet.
- Setbacks: Buildings must be at least 40 feet from the front lot line, 8 feet from side lines (10 feet if the side line is a street line), and 10 feet from the rear lot line.
- Temporary structures & construction timeline: No trailers, tents, shacks, or outbuildings may be used as residences. Construction must be completed within 5 months of starting.
- Nuisance & waste: No obnoxious or offensive activities. Rubbish must be kept in sanitary containers; no surface closets. Sewage disposal must be by septic tank until a public system is available.
- Lot subdivision: Lots may not be resubdivided unless the subdivided part becomes part of a whole lot and the remainder becomes part of another whole lot.
- Duration & amendment: Covenants run for 25 years from recording (1959), then auto-renew every 10 years unless a majority of lot owners record a change.
- Enforcement: Any lot owner may sue to enforce these covenants or recover damages for violations.
