Scotts Hill Bluff is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). This document is the Declaration of Protective Covenants, Restrictions, and Easements that applies to all lot owners in the subdivision. It sets rules for land use, construction, and the HOA's powers.
- Single-family use only: All lots are restricted to single-family residential use. No commercial use is allowed, except the developer may use structures for sales purposes.
- Architectural review: An Architectural Control Committee must approve all construction, landscaping, tree removal (trees 4 inches diameter or larger), fences, satellite dishes, and other improvements. Plans must be submitted at least 30 days before starting work. The committee has 30 days to respond; if no response, plans are deemed approved.
- Building standards: Minimum heated living area: 1,800 sq ft for single-level homes, 2,000 sq ft for two-level homes (with at least 1,400 sq ft on the first floor). Homes must be built on-site (no modular or pre-built homes). Construction must be completed within 12 months. Architectural style must be 'Southern Low Country.'
- Setbacks and impervious surfaces: Structures must be at least 40 feet from street rights-of-way, 15 feet from side lot lines, 50 feet from waterways, and 50 feet from rear lot lines, unless the Architectural Control Committee approves alternatives. Impervious surface coverage per lot is limited to 4,480 square feet on average, with no individual lot exceeding that without special approval.
- Vehicles and storage: Boats, trailers, campers, RVs, utility vehicles, and trucks (2.5 tons or larger) may not remain on streets, lots, or common areas overnight unless enclosed in a garage. The HOA may adopt rules on parking, clotheslines, and trash receptacles.
- Signs: Only certain signs are allowed: a contractor sign (max 4 sq ft, removed after occupancy), an owner identification sign (size and style set by the Architectural Control Committee), HOA directional signs, government-required signs, and developer signs. All other signs require committee approval.
- Assessments and dues: Annual assessments are set by the HOA board. Initial assessment was $50 per lot. Dues for improved lots are double those for unimproved lots. Special assessments require a 70% vote of members, except in emergencies. Unpaid assessments become a lien on the property and may be foreclosed.
- Nuisance and fines: Any activity deemed a nuisance by the HOA is prohibited. The HOA may fine $100 per violation, with each day a continuing violation counting separately. Fines are collected like assessments.
