Eastwind Subdivision is a single-family home community in Wilmington, NC, governed by restrictive covenants recorded in 1979. These rules apply to all residential lots (45–68) and are binding on current and future owners. The developer (Business Properties) retains significant approval authority over construction and design.
- Architectural review: All building plans, specifications, exterior finishes, site plans (including well/septic locations), and construction schedules must be approved in writing by Business Properties or its representative. Approval may be denied for any reason, including aesthetic or environmental considerations, in the developer's sole discretion.
- Minimum house size: Each dwelling must have at least 1,600 square feet of enclosed dwelling area (excluding garages, terraces, decks, open porches). If the garage's main door opens on the side or rear, a minimum of 1,500 square feet is allowed. The specific minimum may be stated in the deed; if not, 1,600 square feet applies.
- Building & use restrictions: Only detached single-family dwellings (up to 2½ stories) and small accessory buildings (e.g., detached garage, but no garage apartments) are allowed. Accessory buildings cannot be built before the main house. No home businesses or occupations are permitted. Temporary structures (trailers, tents) are prohibited except contractor shelters during construction.
- Setbacks & site control: No specific setback lines are established. Instead, Business Properties has absolute control over the location of any structure on a lot to protect privacy, views, trees, and ecology.
- Pets & animals: Only household pets are allowed; no other animals may be kept on the property.
- Maintenance & nuisance: Owners must keep lots clean and well-maintained. No noxious, offensive, or dangerous activities are permitted. Garbage receptacles must be screened from road view.
- Subdividing & lot changes: No lot may be subdivided or its boundaries changed without prior written consent from Business Properties. However, the developer may replat two or more lots, provided no lot is reduced by more than 20% of its original size.
- Duration & amendment: The covenants run for 10 years from May 1979, automatically renewing for successive 10-year periods unless a majority of lot owners (excluding mortgagees) record an instrument to change them.
