Greymarsh Crossing is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). All lot owners are automatically members of the Greymarsh Crossing Owners Association and must follow these covenants, which run with the land.
- Single-family residential only: Only single-family detached homes are allowed. Mobile homes, modular homes, and manufactured homes of any kind are prohibited.
- Architectural review: All building plans, exterior changes, landscaping, tree removal, and site work must be approved by the Developer or an Architectural Review Committee. Plans not approved or rejected within 30 days are deemed approved.
- Tree protection: Pine trees 12" or larger in caliper and hardwoods 5" or larger may not be cut without written consent. Dogwood, holly, and flowering trees 3" or larger in the 25-foot buffer zone also require consent. Violators must pay $1,000 per tree cut.
- Minimum square footage & lot coverage: Each home must have at least 1,600 square feet of heated living space. No more than 3,565 square feet of any lot may be covered by structures or paved surfaces.
- Parking & vehicles: No commercial vehicles (except pick-up trucks) may be parked overnight. All vehicles must be in working order, licensed, and insured. Boats and boat trailers must be stored out of street view.
- Pets: Barnyard animals, exotic animals, and pit bull dogs (American Pit Bull Terrier/Staffordshire Terrier) are prohibited. Other domestic pets are allowed but must be leashed and not kept for commercial purposes. Pens or structures for pets require approval and must be screened.
- Assessments & liens: The Association may levy annual and special assessments on a uniform basis per lot. Unpaid assessments become a lien on the lot, subordinate to first mortgages. Delinquent assessments accrue interest at 1.5% per month and may incur collection costs and attorney's fees.
- Use restrictions: No business or commercial use is allowed without consent. No noxious or offensive activity. No yard or garage sales. No outside antennas, satellite dishes, or clotheslines without approval. No temporary structures or long-term camper parking.
