Kensington Place is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners. It covers use restrictions, maintenance obligations, and HOA assessments.
- What you own & maintain: You own your lot and the home on it. You must maintain your lot in a neat and orderly condition, including mowing grass, pruning, and keeping improvements repaired. The HOA maintains common areas (e.g., subdivision entrance landscaping, fencing, stormwater system) and can enter your lot to perform maintenance if you fail to do so, charging you the cost plus 15%.
- Assessments & fees: Annual assessments are levied per lot. The initial annual assessment was $15 per lot. The HOA board can increase it up to 20% per year without a vote; larger increases require a majority vote of members. Special assessments for capital improvements also require a majority vote. Assessments are a lien on the lot and a personal obligation of the owner. Late payments incur 12% annual interest and a late fee (initially $5).
- Use restrictions: Lots are for single-family residential use only. Minimum heated floor area is 1,350 square feet (exclusive of porches, garages, etc.). Exterior materials are limited to conventional frame, wood, masonite-type hardboard, vinyl, brick, clay brick, or stucco; exposed foundations must be brick, stone, or stucco. No mobile homes, trailers, tents, or temporary structures. No yard or garage sales. No clotheslines visible from the street. No noxious or offensive activities. Household pets allowed subject to local ordinances; no farm animals or fowl.
- Architectural review: All building and landscaping plans must be approved in writing by the developer (or its assignee) before construction. No tree with a diameter over 8 inches at ground level may be cut without written consent. Fences, hedges, and storage buildings require prior approval. Roof pitch must be at least 5/12; shingles must be earth tones. Setback: no house closer than 30 feet to front lot line or 10 feet to side lot line (or county minimum, whichever is greater).
- Parking & vehicles: Each lot must have a paved driveway and off-street parking for at least two passenger cars. No inoperable or unregistered vehicles. No buses, vans, school buses, or vehicles larger than 3/4 ton. Boats must be stored inside a building or in the back yard not visible from the street.
- Leasing & rentals: The document does not restrict leasing or rentals. Owners may delegate use of common areas to tenants, provided the tenant resides on the property.
- Enforcement & violations: The HOA, developer, or any aggrieved owner can enforce the restrictions. The HOA can suspend voting rights and common area use for up to 60 days for rule violations, and for any period during which assessments remain unpaid. The HOA can also remedy violations and assess costs to the offending owner.
