Palmetto Pointe is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). The rules apply to all lot owners, residents, and their guests. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) for the community.
- What you own & maintain: You own your lot and the house on it. You must keep your lot free of weeds, debris, and unsightly growth, and maintain the structure in good repair. The HOA maintains common areas (private roads, stormwater ponds, etc.) and may enter your lot for maintenance if you fail to do so.
- Architectural review: All exterior improvements or modifications (including fences, sheds, paint, etc.) must be approved by the Architectural Control Committee before construction. The committee has 60 days to respond; if they don't, approval is deemed denied. Construction must start within 6 months of approval and be completed within 1 year.
- Leasing & rentals: Leases must be for at least three consecutive months. No short-term rentals (e.g., vacation rentals) are allowed.
- Pets: No more than four dogs, cats, or other household pets per lot. They must be leashed and not become a nuisance. Owners must clean up pet waste immediately.
- Parking & vehicles: Only standard passenger vehicles, passenger vans, and pick-up trucks may be parked. Boats, campers, trailers, RVs, and inoperable vehicles are prohibited on lots or streets. No vehicle repairs in driveways or streets.
- Minimum home size: Each dwelling must have at least 2,400 square feet of enclosed, heated living area (excluding garages, decks, porches, etc.).
- Stormwater & built-upon area limits: Lots 1–5 and 11–15: no more than 4,820 sq ft of structures and paved surfaces. Lots 6–10: no more than 5,900 sq ft. These limits are to comply with state stormwater rules and cannot be changed without state approval.
- Assessments & fees: All lot owners pay annual assessments (set by the HOA board) and may be subject to special assessments for capital improvements, insurance, and ad valorem taxes. A working capital assessment equal to two months' assessments is due at closing. Assessments are a lien on the lot if unpaid.
