Forest Cove Townhouses is a townhome community in Wilmington, NC, where you own your lot and dwelling (a single-family townhouse) and share ownership of common areas through the Forest Cove HOA. The HOA maintains common areas and provides exterior maintenance on each lot (roofs, siding, decks, landscaping, etc.), funded by annual and special assessments. Party walls between units are shared, with repair costs split proportionally.
- What you own & maintain: You own your lot and the townhouse on it. The HOA handles exterior maintenance (roofs, gutters, exterior surfaces, decks, trees, shrubs, grass, walks) but not glass surfaces. You are responsible for interior maintenance and any damage caused by your negligence or certain perils (fire, wind, etc.), in which case the HOA may bill you.
- Assessments & fees: Annual assessments start at a maximum of $1,000 per lot (as of 1990), can increase up to 5% per year without a vote, and higher increases require a 2/3 vote of each membership class. Special assessments for capital improvements also require a 2/3 vote. A working capital assessment equal to two months' estimated assessment is due at closing. Assessments are uniform per lot and may be paid monthly.
- Leasing & rentals: You may rent your unit, but leases must be consistent with the Declaration and HOA rules. The HOA may recommend rental agents but cannot control rental periods or fees. No rental pooling is required.
- Pets: Dogs, cats, or other household pets are allowed, but not for commercial purposes. They must be leashed and escorted when outside; no running free.
- Architectural review: Any exterior changes (buildings, fences, walls, additions, alterations) require prior written approval from the HOA Board or an architectural committee. Plans are deemed approved if no decision is made within 30 days of submission.
- Parking & vehicles: Inoperable vehicles without current registration and insurance are prohibited and may be towed. Boats, campers, trailers, and similar vehicles are not allowed on lots or in parking spaces unless the HOA consents; they must be kept in the designated boat/trailer corral.
- Use restrictions: Lots are for residential use only (single-family townhouses, max 3 stories). No noxious activities, temporary structures, outside antennas (without approval), or 'For Sale' signs (except by developer). Window coverings must include permanent mini-blinds; exterior lights must be clear/white. Front porch furniture is limited to porch furniture and plants; grills must be stored when not in use.
- Party walls: Walls between townhouses are party walls. Repair and maintenance costs are shared proportionally by the owners who use the wall. Disputes are resolved by arbitration.
