Bishops Park at Porters Neck Plantation is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). This document is the Declaration of Protective Covenants that applies to all lots in the subdivision, binding current and future owners to rules about land use, construction, and association membership.
- Single-family use only: Each lot is restricted to single-family residential use only. No commercial use is allowed, except that the developer may use a structure to assist in selling lots.
- Architectural review: An Architectural Control Committee must approve all construction, landscaping, tree removal (trees 4 inches or larger in diameter), and any improvements before work begins. Plans must be submitted at least 30 days in advance, and the committee has 30 days to respond. The committee can approve, deny, or conditionally approve plans.
- Building & site restrictions: Minimum heated living space is 1,650 sq ft for single-level homes and 1,900 sq ft for two-level homes (with at least 1,400 sq ft on the first floor). Setbacks: at least 25 ft from street rights-of-way, 10 ft from side lot lines, 35 ft from rear lot lines, and 25 ft from common recreational property. No modular homes or structures built elsewhere are allowed. No more than one house per lot.
- Parking & vehicles: Boats, trailers, campers, RVs, utility vehicles, and trucks rated one ton or larger may not remain on any street, lot, or common property overnight unless enclosed in a garage. The association may also adopt rules limiting the number of vehicles parked on a lot.
- Pets & nuisances: The association may adopt rules regarding pets. Any activity considered a nuisance by the association is prohibited, and the association may fine $100 per violation per day for continuing nuisances.
- Signs: Only specific signs are allowed: a contractor sign (max 4 sq ft, removed after certificate of occupancy), a property identification sign (size and style set by the architectural committee), a single project sign for townhomes (max 10 sq ft), street/directional signs by the association, government-required signs, and developer/association informational signs off-lot.
- Fences & satellite dishes: Fences (including walls, barricades, shrubbery) require architectural committee approval for location, style, materials, and height. Satellite dishes and radio antennas must be placed in the area of minimum visibility from surrounding lots or streets, subject to committee approval.
- Association membership & assessments: Every lot owner is a voting member of the Bishops Park Homeowners Association (one vote per lot). Annual dues are set by the board; initial annual assessment was $50 per lot. Dues for improved lots (with a certificate of occupancy) are double the rate for unimproved lots. Special assessments require 70% vote of members present, except in emergencies. Unpaid assessments become a lien on the lot and may be foreclosed.
