Pelican Point Estates is a single-family home subdivision in Wilmington, NC, governed by two sets of restrictive covenants. The first (1972) covers lots 26-43 in Section 2; the second (2002) covers 40 lots in a different area and created a property owners' association. These rules apply to lot owners and require homes to be used only for single-family residential purposes.
- What you own & maintain: You own your lot and the house on it. You must keep the lot well-maintained and mowed; the association may mow it at your expense if you don't. You are responsible for damage you cause to streets or common areas.
- Architectural review: An Architectural Control Committee must approve all plans for buildings, fences, and other improvements before construction. Approval is based on harmony of design and materials; the committee may disapprove for purely aesthetic reasons. If no decision is made within 30 days, plans are deemed approved.
- Building & lot standards: Only one detached single-family home per lot, minimum 2,000 sq ft of heated floor space (1,200 sq ft on first level if more than one story). Maximum height is 40 feet above flood zone. Setbacks: 20 ft front, 8 ft side, 15 ft rear, 20 ft on corner side. No mobile homes, manufactured homes, or used structures. Construction must be completed within 12 months.
- Leasing & rentals: Leases must be for a minimum of six months. No duplexes, condos, or apartments are allowed.
- Pets: Dogs, cats, and other small household pets are allowed in reasonable numbers, subject to county leash laws and noise rules. No commercial breeding. No livestock.
- Parking & vehicles: No parking on streets. No trucks over one-ton capacity, mobile homes, or trailers visible overnight. Recreational vehicles and campers are allowed if operable and parked on driveways. No junk or inoperable vehicles.
- Assessments & fees: Annual assessments are set by the board and can increase up to 10% per year without member vote; higher increases require a two-thirds vote. Special assessments for capital improvements also require two-thirds vote. Unpaid assessments become a lien on the lot and accrue 12% interest plus collection costs.
- Tree removal: Live trees over 6 inches in diameter may only be removed with written approval from the board or committee, except within 15 feet of a proposed dwelling. Dead or fallen trees and smaller trees may be removed freely.
