What Holliday Hills's governing documents say
Holliday Hills is a single-family home subdivision in Wilmington, NC, governed by restrictive covenants that run with the land. These rules apply to all current and future owners of lots 2, 4, and 5–31, and are designed to maintain a uniform residential character.
- Residential use only: Lots may be used only for residential purposes. No portion may be used as a public or private roadway, except for driveways incidental to residential use.
- Building & dwelling requirements: Only one detached single-family dwelling (max two stories) and a private garage (max one story, for up to two cars) are allowed. Garages cannot be used as living quarters. Minimum dwelling cost is $8,000, and minimum living area is 1,050 square feet. Exterior finish must be brick or stone, though wood and other standard materials may be used for roofs, windows, doors, gables, and upper stories.
- Setbacks & lot lines: No building may be located nearer than 20 feet from any side lot line or 40 feet from the front lot line. Lot 2 must face Holiday Hills Drive with a 40-foot setback from that drive, and Masonboro Loop Road is considered a side line for that lot.
- Prohibited structures & uses: Temporary structures, trailers, mobile homes, tents, shacks, garage apartments, barns, or other outbuildings may not be used as residences. No commercial, noxious, or nuisance activities are allowed. No dumping of rubbish, trash, or garbage except in sanitary containers; incinerators must be kept clean.
- Animals: Hogs, cattle, sheep, goats, horses, poultry, and other livestock are prohibited. Dogs, cats, and other household pets are allowed but not for commercial breeding or maintenance.
- Sewage & utilities: Surface closets and outhouses are prohibited. Sewage disposal must be by septic tank only, complying with state health board requirements, until a general sewage system is installed. Culverts and pipes in streets or drains must meet state highway standards.
- Lot subdivision & covenant duration: Lots may not be subdivided unless the subdivided part becomes part of a whole lot and the remainder becomes part of another whole lot. These covenants run for 10 years from October 16, 1962, and automatically renew for successive 10-year periods unless a majority of lot owners record a change.
- What this document doesn't cover: This document does not establish a homeowners association, set fees or assessments, regulate leasing or rentals, or address parking, architectural review, or age restrictions.
