What Serenity Point's governing documents say
Serenity Point is a small single-family home subdivision in Wilmington, NC, with no homeowners' association. The developer (or later an unincorporated nonprofit association) administers the covenants, maintains common areas (including a pier and dock), and can levy assessments. This document is the full set of covenants, conditions, and restrictions (CC&Rs) that run with the land and bind all owners.
- No homeowners' association: There is no incorporated HOA. The developer (or later an unincorporated nonprofit association of owners) administers the covenants, maintains common areas, and can impose assessments. Any action by the association requires approval of 75% of owners.
- Common areas & pier: Common areas include roads, open space, drainage areas, and a recreational area with a pier and boat slips. Each lot owner has a non-exclusive easement to use the pier walkway and an exclusive easement to one boat slip (assigned in the deed). Owners share maintenance costs equally, except for damage caused by an owner or their invitees.
- Assessments: Annual assessments are set by the developer (or association) based on a budget, with input from owners. Special assessments may be levied for capital expenses or emergencies. Assessments are a lien on the lot and bear interest if unpaid after 90 days. All lots are assessed at a uniform rate.
- Use restrictions: Lots are for single-family residential use only. No commercial activity, noxious activities, or nuisances are allowed. Temporary structures, tents, and trailers cannot be used as dwellings. Boats, trailers, and RVs must be stored behind the rear wall of the main dwelling.
- Architectural review: All exterior improvements (including painting, fences, and landscaping) require prior approval by the Architectural Review Committee (ARC), which is appointed by the developer. The ARC ensures aesthetic harmony and compliance with stormwater and built-upon area limits. Construction must be completed within 12 months.
- Leasing & rentals: Leases must be for a term of at least one year and in writing. No hotel or transient uses are permitted. All leases are subject to the declaration.
- Pets: No animals may be kept for breeding or commercial purposes. Domestic pets must be restrained and not constitute a nuisance. The number of outdoor pets (e.g., dogs, cats) shall not exceed three, excluding offspring under nine months.
- Parking & vehicles: No commercial vehicles, boats, trailers, campers, or mobile homes may be parked on streets or lots (except in an enclosed structure). Excess vehicles beyond garage capacity may be parked in the driveway. The board may adopt parking rules and remove violating vehicles.
