What Soundview's governing documents say
Soundview is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). The rules apply to all lot owners in Sections I and II, and cover use restrictions, assessments, and maintenance obligations.
- What you own & maintain: You own your lot and any dwelling on it. The association maintains the common areas (Soundview Drive, Area A, Area B). You must keep your lot well-maintained, free of debris, and promptly clean up after construction or casualty.
- Assessments & fees: Annual assessments are $100 per lot with a residence, $35 per lot without, and $10 per additional vacant lot. Lot 1 (commercial) pays $500 if a business operates, or $35 if vacant. Assessments are due by January 31; unpaid amounts become a lien on the property. Increases are capped at 10% per year unless 2/3 of members approve a higher amount.
- Use restrictions: Lots are for single-family residential use only, except Lot 1 in Sections I and II, which may be used commercially. Only one detached single-family dwelling per lot, minimum 1500 sq ft heated floor area (excluding porches, garages). No mobile homes, manufactured homes, trailers, or temporary structures. Construction must be completed within 12 months of starting.
- Pets: Dogs, cats, or other household pets are allowed in reasonable numbers, provided they do not create a danger or nuisance. No livestock or poultry.
- Parking & vehicles: No parking on Soundview Drive except for guests visiting an owner. No junked motor vehicles or parts may be kept on any lot or common area.
- Leasing & rentals: All lessees must comply with the declaration, covenants, and restrictions. Owners must attach a copy to the lease. Failure by the lessee to comply is grounds for lease termination and eviction.
- Architectural review: No structure may be used as a model exhibit or house without prior written permission from the Board of Directors. The Board may grant variances to alleviate practical difficulties, provided they do not violate the spirit of the declaration.
