Masonborough Plantation is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). The rules apply to all lot owners and are designed to maintain a uniform, high-end residential character.
- Lot use & construction standards: Lots are for residential use only. Houses must have at least 2,800 heated square feet, be built on a crawl space, and cannot be mobile, modular, or manufactured homes. Construction must start within 12 months of lot purchase and finish within 12 months of starting.
- Architectural & landscape review: All building designs, site plans, and landscaping must be approved by an Architectural Control Committee. Exterior colors cannot be changed without written permission. A $2,000 deposit is required for construction to cover trash cleanup and road repairs.
- Maintenance & nuisances: Owners must keep lots neat and free of debris. No statues, yard decorations, or vegetable gardens in front yards. No noxious activities. The HOA can clean up and charge the owner if they fail to maintain the lot.
- Parking & vehicles: Vehicles must park in driveways only; no parking on lawns, roads, or common areas. Inoperable vehicles, tractor-trailers, and boats/RVs cannot be stored openly. Vehicle repairs must be completed in one day.
- Pets: No more than 4 household pets per lot. Pets must be leashed or fenced, and owners must clean up pet waste. No livestock or poultry allowed.
- Leasing & rentals: Leasing is allowed only in accordance with HOA rules. No garage sales, yard sales, or rummage sales are permitted.
- Assessments & fees: Annual assessments are set by the HOA board and can increase up to 10% per year without member vote. Special assessments require a 2/3 vote of Class A members. A nonrefundable working capital assessment of 3 months' annual assessment is due at purchase. Unpaid assessments accrue interest and can become a lien on the lot.
- Common areas & amenities: The HOA maintains common areas including a boat dock, gazebo, pavilion, and park. Use of the pavilion is by reservation; transient dock tie-up is limited to 60 minutes. Boat slips are reserved for members of a separate Boat Owners Association.
