Cliffside Subdivision is a single-family home neighborhood in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land. These rules apply to all lot owners and residents, promoting uniform residential development.
- Permitted uses: All lots are for residential use only, except lots 1 & 2 which may be designated for residential or commercial use by the developers. No commercial trade or nuisance activity is allowed on any lot.
- Building & dwelling requirements: Only one detached single-family dwelling (max two stories) and a private garage (max one story, no living quarters) per lot. Minimum living area: 1,350 sq ft for lots 7-9 & 17-39; 1,250 sq ft for lots 3-6 & 10-16. At least 60% of exterior finish (excluding roof) must be brick, brick veneer, or stone.
- Setbacks & placement: Front setback: 30 ft for lots 16 & 27-30; 40 ft for all other lots (except 1 & 2). Side setback: 10 ft from side lines. Lots 13 & 14 must face Cliffside Drive. Eaves overhang up to 3 ft and uncovered stoops/steps are allowed within setbacks.
- Pets & livestock: No hogs, cattle, sheep, goats, horses, poultry, or other livestock. Dogs, cats, or other household pets may be kept but not bred or maintained for commercial purposes.
- Temporary structures & residences: No trailer, mobile home, tent, shack, garage, garage apartment, barn, or other outbuilding may be used as a residence, even temporarily.
- Sanitation & waste: No dumping of rubbish, trash, or garbage; waste must be kept in sanitary containers. Incinerators must be kept clean. No surface closets or outhouses; sewage disposal by septic tank only until a general system is installed.
- Lot subdivision & water rights: Lots cannot be subdivided unless the subdivided part merges with an adjacent lot. All lots are subject to a water supply agreement with Quality Water Supplies (recorded in Book 797, Page 272).
- Duration & enforcement: Covenants run for 30 years from June 1968, automatically renewing for successive 30-year periods unless a majority of lot owners record a change. Any lot owner may enforce these covenants through legal proceedings.
