Sound View Subdivision is a single-family home subdivision in Wilmington, NC. These restrictions run with the land and bind all current and future lot owners. The document sets rules for residential use, building size and placement, and prohibits commercial activity (except on Lot 1).
- Permitted use: All lots are restricted to residential use only, except Lot 1 which may be used for residential or commercial purposes (or both). No lot may be used as a public or private street or roadway, except for incidental driveways.
- Building restrictions: Only one detached single-family dwelling (max two stories) and a private garage for up to two cars are allowed per lot. The dwelling must cost at least $5,000. No temporary structures, trailers, tents, or outbuildings may be used as a residence, though servant quarters above a garage are permitted after the main building is completed.
- Setbacks: Buildings must be at least 30 feet from the front lot line and 10 feet from any side lot line.
- Nuisance & waste: No noxious or offensive trade or activity is allowed. Lots may not be used as dumping grounds; trash must be kept in sanitary containers. Incinerators must be kept clean. Surface closets are prohibited; sewage disposal must be by septic tank complying with state health board requirements until a general system is installed.
- Animals: No livestock or poultry may be raised, bred, or kept. Dogs, cats, or other household pets are allowed but not for commercial purposes.
- Lot subdivision: Lots may not be resubdivided unless the subdivided part becomes part of a whole lot and the remaining part becomes part of another whole lot.
- Duration & amendment: These covenants run for 25 years from the recording date (April 1961) and automatically renew for successive 10-year periods unless a majority of lot owners record an instrument to change them.
