Glen Arbor is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land. These rules apply to all lot owners and are designed to maintain the residential character of the neighborhood.
- Residential use only: All lots are for single-family residential use only. No business may be conducted from a residence if there is any outward evidence (signs, commercial vehicles, materials stored outside, or many cars).
- Building & lot standards: Only one detached single-family dwelling (max 2½ stories) and a private garage (max 3 cars) plus incidental outbuildings are allowed. Minimum floor area is 1,250 sq ft (excluding porches, garages, terraces, outbuildings). Setbacks: at least 50 ft from front, 15 ft from sides, 25 ft from rear. Unattached garages/outbuildings must be at least 75 ft from front, 5 ft from sides/rear.
- Construction timeline: A residence must be built within 3 years of purchase from the developer, or the developer may repurchase the lot. Once construction begins, it cannot remain unfinished for more than 6 months (or if exterior is finished, that satisfies the rule).
- Nuisances & maintenance: No noxious or offensive trade/activity, no domesticated farm animals or fowls. Yards must be properly maintained; unsightly inoperative junk cars and similar eyesores are prohibited.
- Fences: No fence may be placed beyond the front of the residence unless it is ornamental.
- Modification & expiration: Restrictions may be altered by a written document signed by the original developers and owners of at least 55% of the lots. If not modified, restrictions expire on December 31, 2018.
