North Bend Subdivision is a single-family residential subdivision in Wilmington, NC. These covenants run with the land and bind all lot owners, ensuring the neighborhood remains attractive and residential. The document was recorded in 1986 and automatically renews every 10 years unless a majority of owners vote to change it.
- Land use & building type: All lots are for single-family residential use only. Dwellings cannot exceed 2.5 stories, and must have at least 1,000 square feet of heated living area (excluding porches, garages, etc.).
- Architectural review: Plans and locations for any building (including garages, guest houses, sheds) must be approved in advance by the developer (or its agent). If no decision is made within 10 days of submission, approval is not required as long as other rules are met and the design is in harmony with existing homes.
- Setbacks & lot lines: Buildings must be at least 25 feet from the front property line and 10 feet from side boundaries. On corner lots, the side with less street frontage is considered the front. If two lots are combined for one residence, the interior boundary is not treated as a side line.
- Prohibited structures & uses: No house trailers, mobile homes, tents, shacks, or temporary structures may be used as residences. No noxious or offensive activities, and no domesticated farm animals or fowl are allowed.
- Fences & signs: Fences cannot be placed closer to the front street than the rear corners of the house, and must be wood or chain link. Signs are limited to name plates, 'For Sale' or 'For Rent' signs only.
- Utilities & drainage: Water must come from the community water system; no wells without consent. Sewage must be by septic tank until municipal sewer is available. Owners must install and maintain a culvert/drain pipe (minimum 12-inch diameter) under their driveway to avoid blocking drainage.
- Maintenance & nuisances: Owners must maintain their yards and keep the property free of inoperative junk cars and eyesores. If not maintained, the association may clean up at owner's expense, creating a lien on the property.
- Duration & amendment: These covenants run for 20 years from February 1986, then automatically renew for successive 10-year periods unless a majority of lot owners vote to revoke or amend them.
