This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that run with the land and bind all owners, residents, and guests. It establishes the Lucky Fish Subdivision HOA, defines common areas including a community boating facility on Pages Creek, and sets rules for property use, maintenance, assessments, and architectural control.
- What you own & maintain: You own your lot and the single-family home on it. You are responsible for maintaining your dwelling, yard, and any stormwater management improvements on your lot. The HOA maintains all common areas, including private streets, landscaping, and the community boating facility.
- Community boating facility: The subdivision includes a community boating facility with three 6' x 40' floating docks and four boat lifts on Pages Creek. Each lot owner is assigned one boat slip as an appurtenance to membership. The facility is for non-commercial use only, and no sewage may be discharged from boats.
- Leasing & rentals: No home may be leased for transient or hotel purposes, and no lease may be for a period of less than six months. You cannot lease less than the entire dwelling. All leases must be in writing and subject to the declaration and HOA rules.
- Architectural review: All exterior improvements, including buildings, fences, decks, and landscaping, require prior written approval from the Architectural Control Committee (ACC). Minimum house size is 2,500 square feet of enclosed heated/cooled area (excluding garages and porches). The ACC has 10 days to approve or disapprove plans.
- Assessments & fees: Annual assessments are shared equally per lot. The maximum annual assessment during developer control is $2,000 per lot. After that, the board can increase assessments up to 20% per year without a membership vote; larger increases require a 2/3 vote. A working capital assessment equal to two months' estimated annual assessment is due at closing.
- Parking & vehicles: No trucks over 3/4 ton, boats, or trailers may be stored on the property except inside an enclosed garage. On-street parking is prohibited; each owner must provide off-street parking on their lot.
- Use restrictions: Lots are for single-family residential use only. No commercial activity is allowed, though the HOA may permit certain home occupations. No signs, nuisances, or activities that increase insurance rates are permitted. Stormwater runoff limits apply: no more than 4,300 square feet of built-upon area per lot, and overall tract impervious surface cannot exceed 25%.
- Developer control period: The developer (Declarant) retains control of the HOA until 6 lots are sold or September 1, 2015, whichever comes first. During this period, the developer has special voting rights (2 votes per each Class A vote) and can amend the declaration without member consent for certain purposes.
