Baldwin Woods is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs) that run with the land. The rules apply to all lot owners and are designed to protect property values and maintain a uniform residential character.
- Architectural review: All new construction, exterior additions, fences, and other structures require written approval from the Developer (or its designee) based on harmony of design and location. Plans must show nature, kind, shape, height, materials, and location.
- Minimum house size: Each single-family dwelling must have at least 1,600 square feet of finished, heated enclosed area (excluding garages, decks, porches, etc.). An attached garage for at least one car is required.
- Construction timeline: Exterior of all houses and other structures must be completed within 12 months after construction begins, unless delayed by strikes, fires, national emergency, or natural calamities.
- Single-family use only: Only one detached single-family dwelling and a garage for up to two cars are allowed per lot. No garage-apartments or living quarters in detached garages. Storage/utility buildings require Developer's written consent.
- Setbacks & easements: Buildings must be at least 30 feet from the front lot line, 10 feet from side/rear lot lines (detached garages and approved storage may be 5 feet from side/rear). Eaves overhang up to 3 feet and uncovered stoops/patios/decks/steps are allowed within setbacks. Utility and drainage easements (10 ft front, 5 ft side/rear) are reserved.
- Vehicles & parking: Boats, campers, trailers, motor homes, mobile homes, trucks over 3/4 ton, and similar vehicles are not allowed on lots unless stored in an enclosed area not visible from streets, or with written permission from the Developer.
- Pets: Only domesticated dogs, cats, or other household pets are allowed, not for commercial breeding. Housing for pets must be screened with Developer-approved fencing. Animals must be leashed when not housed.
- Prohibited structures & uses: No trailers, mobile homes (including double-wide), tents, shacks, barns, or temporary structures. No commercial or noxious activities. No dumping of rubbish except in sanitary containers. No signs except 'For Sale' or 'For Rent' signs up to 6 sq ft.
