Stoneybrook Subdivision is a single-family residential neighborhood in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1978. These covenants run with the land and apply to all lot owners, primarily regulating lot use, building size, setbacks, exterior materials, and nuisances.
- Permitted use: All lots are restricted to single-family residential use only. No noxious or offensive trades, activities, or nuisances are allowed.
- Minimum home size: Any residence must be at least 1,200 square feet, measured by exterior brick work, excluding porches, steps, walks, garages, carports, and storage areas.
- Exterior materials: Exteriors must be conventional frame or clay brick. Concrete block, concrete brick, asbestos siding, cinder block, and composition tar paper are prohibited.
- Setbacks: Buildings must be at least 40 feet from the front property line and 15 feet from side boundary lines. On corner lots, the side with the least frontage is considered the front lot line.
- Temporary structures & vehicles: No house trailers, mobile homes, tents, shacks, or temporary structures may be used as residences. Inoperative junk cars and similar eyesores are not allowed.
- Signs: Only private name plates, residence identification signs, and 'For Rent' or 'For Sale' signs are permitted.
- Animals: No domesticated farm animals or fowls may be kept on the property.
- Duration & amendment: The covenants run for 20 years from November 1978 and automatically extend unless a majority of lot owners vote to revoke or amend them.
