What Queens Point's governing documents say
Queens Point is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1970. These covenants run with the land and apply to all lots in Section 2A, binding current and future owners. The rules cover residential use, minimum house size and cost, setbacks, and architectural approval, but do not create a homeowners association or impose fees.
- Residential use & building type: Each lot may contain only one detached single-family dwelling (max 2.5 stories) and a private garage for up to two cars. No temporary structures, trailers, tents, or outbuildings may be used as residences.
- Minimum dwelling size & cost: Dwellings must cost at least $10,500 (based on 1970 cost levels). Minimum ground floor area: 1,000 sq ft for one-story homes, or 800 sq ft for homes with more than one story (excluding open porches and garages).
- Setbacks & lot requirements: Buildings must comply with setback lines shown on the recorded plat. No building may be within 10 feet of an interior lot line (except garages or accessory buildings set back 100+ feet). Minimum lot width at setback line: 70 feet; minimum lot area: 10,000 sq ft.
- Nuisance & offensive activities: No noxious or offensive activities are allowed on any lot, nor anything that may become an annoyance or nuisance to the neighborhood.
- Fences: No fence may be placed across the front of a lot nearer the street than the front of the house, nor nearer a side street than the side of the house.
- Utilities & drainage easements: Easements for utilities and drainage exist over the rear 10 feet of each lot and as shown on the plat. Owners must maintain these easements and cannot place structures or plantings that interfere with utilities or drainage.
- Architectural review: Building designs must be approved by the Developer (or its nominee). The Developer has 10 days to approve or disapprove plans; failure to act within that time is deemed approval.
- Duration & amendment: These covenants run for 25 years from May 1970, then auto-renew for successive 10-year periods unless a majority of lot owners agree to change them. The Developer may amend for minor violations (up to 10% of a restriction) with the affected owner's consent.
