Carolina Beach Village is a single-family home HOA in Wilmington, NC. This declaration of covenants, conditions, and restrictions (CC&Rs) governs the subdivision and binds all lot owners. It covers use restrictions, architectural review, assessments, and conservation areas.
- What you own & maintain: You own your lot and house. You must maintain your property to prevent unsightly conditions, and you are responsible for drainage easements on your lot.
- Architectural review: All exterior construction, alterations, fences, and landscaping must be approved in writing by the Board or an architectural committee. If no decision within 30 days, approval is deemed given. Minimum home size is 1,400 heated sq ft (exclusive of porches, garages). No slab foundations; homes must be on crawl space. Exterior materials limited to conventional frame, wood siding, or brick. Minimum double-wide concrete driveway required.
- Leasing & rentals: Leases must be for at least 12 consecutive months. All rentals must comply with association rules.
- Pets: Dogs, cats, and other household pets are allowed but not for commercial purposes. They must be leashed and not run free. No livestock, pigs, or poultry.
- Parking & vehicles: No boats, motor boats, dune buggies, campers, trailers, RVs, vehicles on cinder blocks, or tractor-trailer trucks may remain on any lot without association consent.
- Fences & landscaping: Fences, walls, or hedges cannot exceed 4 feet in height and must be set back behind the rear corner of the house. Fences must be wood and stained to match the house. No chain link or wire fences. Landscaping must be in place within 30 days of certificate of occupancy.
- Conservation & historic preservation areas: Certain areas on the plat are designated as conservation or historic preservation areas. These must remain in their natural state in perpetuity, with strict prohibitions on alteration, construction, vegetation removal, and other activities. Enforceable by the U.S. Army Corps of Engineers.
- Assessments & fees: Annual assessments are set by the Board. Special assessments for capital improvements require a 2/3 vote of each class. Assessments are a lien on the property. Interest on late payments is 14% per annum. The developer is exempt from assessments on unsold lots.
