Island Oaks on Saint Joseph Street is a standard single-family home subdivision in Wilmington, NC, with 14 lots. These restrictive covenants run with the land and bind all current and future owners, tenants, and occupants.
- Residential use only: Lots may only be used for residential purposes. No commercial trade or activity is allowed on any lot.
- Building & size requirements: Only one detached single-family dwelling per lot, minimum 1,600 square feet (excluding porches, garages, carports), maximum 35 feet in height. Each home must have a private one-car garage (no more than two stories). Prefabricated, modular, trailer, and mobile homes are prohibited.
- Architectural review: An Architectural Control Committee (ACC) must approve all landscaping and construction plans at least 30 days before starting. Plans must include a plat, elevations, materials, colors, and a landscape plan. The ACC decides within 30 days; if no response, plans are deemed approved. Denials can be appealed to the Board of Directors, which can override only by unanimous vote.
- Association & assessments: A homeowners association (HOA) is established; each lot gets one vote. The HOA maintains private streets, streetlights, and common areas. Annual assessments start at $200 per lot, set by the Board. Special assessments require 70% of votes cast (or Board action in emergencies). Unpaid assessments become a lien on the lot, with 12% annual interest and collection costs.
- Pets: Only household pets allowed, not for commercial breeding. Pets must be kept inside, in an approved fenced area out of sight from the road, or on a leash.
- Parking & vehicles: No mechanical work on cars in front/side yards or streets. Boats, RVs, and similar vehicles must not be visible from the street. Semi-trucks and commercial vehicles are prohibited. Junk cars and inoperative machines are not allowed on the property.
- Fences & structures: Fences over 5 feet high must not extend nearer the street than the rear line of the main dwelling. All fences require ACC approval for design, height, type, and appearance. Temporary structures, trailers, tents, and outbuildings cannot be used as residences.
- Maintenance & nuisances: Owners must keep lots neat, free of debris, and maintain drainage ditches. No noxious or offensive activities. Damaged buildings must be cleared within 90 days. Clotheslines must be screened from public view.
