Risley Homes is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). This document is the Declaration of Covenants, Conditions and Restrictions (CC&Rs) that applies to all lot owners and residents.
- What you own & maintain: You own your lot and the home on it. The HOA maintains common areas, including roads, drainage easements, and landscaping for the entire project, and pressure washes each house once per year.
- Leasing & rentals: Leases must be for at least 12 consecutive months. Short-term rentals are prohibited. Leasing is subject to HOA rules.
- Pets: Dogs, cats, and other household pets are allowed, but not for commercial purposes. Pets must be leashed at all times, and owners must immediately remove waste from rights-of-way, common areas, and vacant lots.
- Architectural review: No building, fence, wall, or other structure may be built or altered without written approval from the Declarant (or its committee). Plans must be submitted; if not approved or disapproved within 30 days, approval is deemed given. Landscaping must be in place within 30 days of certificate of occupancy.
- Parking & vehicles: No dune buggies, campers, trailers, RVs, cars on cinder blocks, tractor-trailers, or similar vehicles may remain on any lot without consent. Boats under 24 feet on trailers may be placed in designated areas. No mechanical work on boats except washing and cleaning. Basketball goals are not permitted in driveways.
- Fences & hedges: Fences, walls, or hedges cannot exceed 5 feet in height and must be set back behind the rear corner of the dwelling. No chain link or wire fences allowed. All fencing requires Declarant approval.
- Other restrictions: No advertising signs (except by Declarant), no above-ground pools, no clotheslines or skating ramps, no yard or garage sales without consent, no large tree removal without approval, and no exposed fuel tanks. Seasonal decorations must be removed within 60 days of holidays.
