Members own a boat slip (20, 25, or 30 feet) and share common areas like docks and piers. This document governs the boat-slip membership, not the condominium units themselves.
- Membership eligibility & transfer: Only owners of units in Harbor Oaks Condominium, Phase I, can hold a membership (one slip per unit). Tenants of those units may use the slip. Memberships cannot be sold, transferred, or leased without Board approval, and any sale without approval is voidable.
- Boat slip sizes & overhang limits: Slips come in three categories: A (max 20 ft boat), B (max 25 ft), C (max 30 ft). Boats may exceed slip length by up to 10%, with specific overhang limits: e.g., a 20-ft slip allows stern flush with finger pier and bow no more than 2 ft into the main walkway.
- Assessments & fees: Members pay annual and special assessments. Special assessments over $200 per member per year require a 2/3 vote of members. Unpaid assessments become a lien on the membership and may lead to suspension or foreclosure.
- Use restrictions: No commercial, illegal, or obnoxious use of slips or common areas. The Board can make and enforce rules, suspend membership for up to 30 days for infractions, and suspend rights for nonpayment.
