Lanier Landing is a single-family home HOA in Wilmington, NC, governed by a Declaration of Covenants, Conditions, and Restrictions. This document establishes the homeowners' association, sets rules for property use and maintenance, and applies to all lot owners. It is a standard planned community under the North Carolina Planned Community Act.
- What you own & maintain: You own your lot and the dwelling on it. The association may maintain common areas (currently only a stormwater pond and private right-of-way, which may be transferred to the town), but if no common areas exist, the association has no common property to maintain.
- Architectural review: All exterior improvements or modifications require prior approval from the Architectural Control Committee (appointed by the developer initially, later by the association). The committee can consider aesthetics and has 60 days to respond; failure to respond counts as denial. Construction must start within 6 months of approval and be completed within 1 year.
- Leasing & rentals: Leases must be for at least three consecutive months. No short-term rentals are allowed.
- Pets: Dogs, cats, and other household pets are allowed but not for commercial purposes. They must be leashed and under control, and owners must clean up waste. No livestock or poultry.
- Parking & vehicles: Only standard passenger vehicles (including passenger vans and pick-up trucks) with current licenses and in operating condition may be parked. Boats and recreational vehicles must be parked on driveways or pads. No inoperable vehicles; no vehicle repairs visible from the street.
- Minimum dwelling size: Each home must have at least 1,500 square feet of enclosed, heated living area (excluding garages, decks, porches, etc.).
- Assessments & fees: Annual assessments are set by the board based on an adopted budget. Special assessments for capital improvements require majority approval. New owners pay a working capital assessment equal to two months' assessments. Unpaid assessments accrue interest and can become a lien on the lot.
- Use restrictions: Lots are for single-family residential use only. No nuisances, temporary structures as residences, or signs (except one builder sign before occupancy). Christmas decorations allowed only Nov 20–Jan 7. Satellite dishes under 18 inches not visible from the street are permitted.
