Whitehurst is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Covenants, Conditions and Restrictions (CCRs) that run with the land. These rules apply to all lot owners and are designed to maintain the residential character and attractiveness of the community.
- Residential use only: All lots are restricted to single-family residential use only. No commercial or other non-residential uses are permitted.
- Minimum home size: Each residence must have at least 1,400 square feet of heated floor space, excluding porches, garages, and other non-living areas. A variance of up to 10% below this minimum may be approved by the developer.
- Exterior materials: Exterior walls must be conventional frame, brick, clay brick, or stucco. Concrete block, concrete brick, asbestos siding, vinyl siding, aluminum siding, cinder block, and tar paper are prohibited.
- Setbacks and fences: Houses must be set back at least 30 feet from the front lot line and 10 feet from side lot lines. Fences and hedges cannot exceed 4 feet in height and must be located behind the rear corners of the house.
- Prohibited structures: No house trailers, mobile homes, tents, shacks, modular homes, prefabricated homes, or previously constructed houses are allowed. Temporary structures cannot be used as residences.
- Landscaping and maintenance: Lots must be kept mowed and free of unsightly objects. Garbage receptacles must be screened from street view except on pickup days. No inoperative junk cars or farm animals are permitted.
- Architectural review: All building plans must be approved by the developer before construction. No lot may be clear-cut without written consent.
