Fawn Creek is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1988. These covenants run with the land and bind all current and future lot owners.
- Residential use only: All lots must be used for residential purposes only. Only one detached single-family dwelling (max 2.5 stories) plus a one- or two-car garage is allowed per lot.
- Architectural review: The developer (or their designee) must approve the design, location, and materials of all buildings, including storage buildings and detached garages. Approval is deemed given if not acted upon within 10 days of a written request.
- Building materials: Dwellings must be wood, brick, brick veneer, concrete block with brick veneer, vinyl siding, composition board, or other approved synthetic materials. Accessory structures must match the main dwelling in material, color, and appearance.
- Pets: Only household pets are allowed, and they may not be kept for commercial purposes. Pets must be kept inside, in an approved fenced area, or on a leash.
- Property maintenance & nuisances: Owners must keep their property neat and tidy, free of debris, junk cars, inoperative machinery, and other eyesores. No noxious or offensive activities are allowed. Mechanical work on vehicles is limited to back yards.
- Parking & vehicles: No more than two motor vehicles per home, both in good running order. Boats, RVs, and semi-trucks may only be parked in the back yard. No parking in front or side yards or on the street in front of the home.
- Fences: Fences are allowed only on the rear portion of the lot (no closer to the front street than the rear corner of the house). All fences must be of the same design, height, type, and general appearance as the first fence approved by the developer.
- Duration & amendment: These restrictions remain in effect until December 31, 2018, and automatically renew for successive 10-year periods unless amended or revoked by a recorded instrument signed by owners of at least 51% of the lots.
