Evergreen Park is a single-family home HOA in Wilmington, NC. The rules apply to all lot owners and residents, covering residential use, construction standards, and community maintenance.
- Residential use only: All lots are for single-family residential use only. An in-home office is allowed if it doesn't generate extensive vehicular traffic.
- Minimum house size: Single-story homes must be at least 1,600 sq ft; two-story homes at least 1,850 sq ft (excluding garages, decks, etc.). A 10% variance may be approved by the developer.
- Architectural review: All building plans, exterior materials, colors, landscaping, and fencing must be approved by the developer (or later the HOA) before construction. Trees over certain sizes require identification.
- Parking & vehicles: Boats, trucks, campers, and recreational vehicles cannot be parked on common areas or streets, and must be kept in a garage. No parking on unimproved lots except by the developer.
- Pets: No more than four household pets per lot. Pets must be restrained or confined to the owner's fenced backyard or inside the house (except cats). No livestock or commercial breeding.
- Fencing & landscaping: Fences require prior approval and cannot extend past the rear corners of the house. Front yards must be sodded and landscaped at least to the rear corners of the dwelling.
- Assessments & liens: Annual assessments are set by the board and can increase up to 10% per year without a vote; larger increases need 2/3 member approval. Unpaid assessments accrue 10% annual interest and become a lien on the property.
- Common areas & amenities: The HOA maintains private streets, a pool, clubhouse, tennis court, walkways, and retention ponds. Owners have an easement to use common areas, subject to HOA rules.
