It includes a community boating facility with 7 boat slips on Whiskey Creek. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that bind all lot owners.
- What you own & maintain: You own your lot and the house on it. The association maintains common elements, including private streets, landscaping, and the community boating facility. Each lot owner is responsible for maintaining their own dwelling and lot.
- Community boating facility: The community has a boating facility with 7 boat slips, one assigned per lot. Slips cannot be sold, leased, or rented to non-owners. Boats over 24 feet require board approval. No commercial use is allowed. The facility is subject to special use permits and environmental regulations.
- Architectural review: All exterior improvements, including buildings, fences, decks, and landscaping, require prior written approval from the Architectural Control Committee (ACC). Houses must have at least 2,600 square feet of enclosed heated dwelling area. The ACC has broad discretion over aesthetics and environmental impact.
- Leasing & rentals: Leases must be for at least 3 months; transient or hotel use is prohibited. All leases must be in writing and acknowledge that the tenant is bound by the declaration and association rules.
- Assessments & fees: Annual assessments are capped at $1,500 per lot until January 1, 2018, after which the board can increase by up to 20% per year without a member vote. No signs, nuisances, or activities that increase insurance rates are permitted. Stormwater runoff limits apply: built-upon area per lot cannot exceed 25% of the tract.
- Easements & utilities: Utility and drainage easements exist along the rear, front, and side 10 feet of each lot. The association has an easement for landscaping and maintenance on buffer areas. Lots must connect to the Cape Fear Public Utility Authority water and sewer systems at owner expense.
