This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that apply to all lot owners, residents, and tenants. It covers property rights, assessments, use restrictions, architectural control, and stormwater management.
- What you own & maintain: You own your lot and the dwelling on it. The HOA maintains common elements (private roads, greenways, open spaces, stormwater basins) and perimeter buffers. You must keep your lot free of weeds, unsightly objects, and maintain landscaping; the HOA may provide lawn care for front and side yards at its discretion.
- Architectural review: All exterior changes (dwellings, fences, painting, landscaping) require prior written approval from the Architectural Review Committee (ARC). The ARC has 30 days to respond; if no response, approval is deemed given. Minimum dwelling size: 1,600 sq ft for single-story, 2,000 sq ft for multi-story (at least 1,200 sq ft on first floor).
- Leasing & rentals: Leases must be for at least six months and in writing, and must include a provision binding the tenant to the declaration and HOA rules. No short-term rentals.
- Pets & animals: Household pets (cats, dogs) are allowed but not for commercial purposes. Pit bulls and Rottweilers are prohibited. Pets must be leashed and not left unattended outdoors. No staking or tying pets in common areas.
- Parking & vehicles: Each lot must provide off-street parking for at least two cars. Boats, campers, trailers, mobile homes, and inoperable vehicles are not allowed on lots or streets without HOA consent. Vehicle repairs visible from the street are prohibited.
- Assessments & fees: Annual assessments fund common area maintenance, insurance, and operations. Special assessments require 2/3 owner vote (except for certain Declarant reimbursements). A one-time working capital fee of $300 is due at lot purchase from Declarant. Assessments are a lien on the lot if unpaid.
- Use restrictions: Lots are for single-family residential use only. No noxious activities, temporary structures, or commercial uses. Clotheslines are prohibited. Flags: U.S. and NC flags up to 4'x6' allowed; other flags require ARC approval. Political signs allowed 45 days before to 7 days after an election, max 24"x24".
- Stormwater & environmental: Maximum built-upon area per lot is 4,500 sq ft. Stormwater facilities are common elements maintained by the HOA. Wetlands on the property must not be disturbed. A 25-foot perimeter preservation buffer must be maintained by the HOA with only hand clearing allowed.
