Ashley Forest is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land. These rules apply to all lot owners and are designed to maintain the area for attractive residential use.
- Residential use only: All lots are for single-family residential purposes only. No house trailers, mobile homes, travel trailers, tents, shacks, or temporary structures may be used as residences.
- Minimum house size: Each residence must have at least 1,300 square feet of heated floor space, excluding porches, steps, walks, garages, carports, and storage areas. The developer may approve dwellings up to 10% smaller.
- Impervious cover limit: No more than 2,917 square feet of any lot may be covered by structures or paved surfaces (including walkways, driveways, patios) to comply with North Carolina Coastal Stormwater Regulations.
- Architectural & site approval: All building plans, site locations, and landscaping plans (including irrigation and sodding) must be approved by the developer before construction. A plot plan is required.
- Exterior materials: Exteriors must be conventional frame, brick, wood, clay brick, stucco, or vinyl. Concrete block, concrete brick, asbestos siding, aluminum siding, cinder block, and tar paper are prohibited.
- Fences, signs, and satellite dishes: Fences and hedges require written approval; no fence is allowed in front of the rear corner of the house. Only one 'For Sale' sign (max 5 sq ft) is allowed on improved lots. No satellite dishes are permitted.
- Vehicles, boats, and parking: Boats must not be visible from the street. Off-street parking for at least two cars must be provided, with driveways and parking areas of concrete, asphalt, brick, or landscape paving blocks. Unsightly or inoperative vehicles are prohibited.
- Yard maintenance and nuisances: Lots must be mowed regularly; no yard sales, garage sales, clotheslines, or noxious activities. No domesticated farm animals or fowls. Kennels are not allowed in front or side yards.
