Masonboro Forest is a single-family home HOA in Wilmington, NC. This document is the main Declaration of Covenants, Conditions and Restrictions (CC&Rs) that applies to all lots in the subdivision. It also includes a 2000 amendment that created a sub-association (Stratton Village) with additional maintenance responsibilities for certain lots.
- What you own & maintain: You own your lot and home. The Association maintains the Common Area (clubhouse, pool, tennis courts, roads) and may also maintain front and rear yards for lots in Stratton Village (per the 2000 amendment).
- Architectural review: Any landscaping, construction, or exterior changes require prior approval from the Architectural Control Committee. Plans must be submitted at least 30 days before starting work. The committee can approve, deny, or conditionally approve, and decisions can be appealed to the Board.
- Leasing & rentals: No living unit may be leased for a term less than one month. Owners may delegate their common area use rights to tenants who reside on the property.
- Parking & vehicles: No vehicles deemed inappropriate for overnight parking in a residential subdivision (e.g., tractor/trailer trucks, heavy construction equipment) may be parked on any lot, association property, or right-of-way.
- Pets & nuisances: No activity considered a nuisance by the Association is allowed. The Association may adopt rules and can declare any conduct a nuisance even if not specifically prohibited.
- Assessments & fees: Annual assessments are levied per lot. The initial maximum was $240/year, with annual increases up to 5% without a vote. Special assessments require 2/3 member approval. Supplemental assessments may apply for yard maintenance in Stratton Village. Unpaid assessments accrue 18% annual interest and become a lien on the lot.
- Housing size & lot categories: Lots are divided into three size categories: 100' lots (min. 2,400 sq ft), 90' lots (min. 1,800 sq ft), and 55' lots (min. 1,400 sq ft). Impervious surface limits also apply per Exhibit D.
- Fences & satellite dishes: Fences require committee approval; generally not allowed along property lines, in front yards, or side yards. Satellite dishes up to 24 inches are allowed only with committee approval on location and screening.
