What Settler's Landing's governing documents say
Settler's Landing is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land. These rules apply to all lot owners and are enforced by the developer (or its assignee) until 2014, then automatically renew every 10 years unless a majority of owners vote to change them.
- Residential use only: All lots are for single-family residential use only. No house trailers, mobile homes, travel trailers, tents, or temporary structures may be used as a residence.
- Minimum house size: Each residence must have at least 1,200 square feet of heated floor space, excluding porches, steps, garages, carports, and storage areas. The developer may approve a dwelling up to 10% smaller.
- Building materials & design: Exteriors must be conventional frame, brick, wood, clay brick, or stucco. Concrete block, asbestos siding, aluminum siding, and tar paper are prohibited. All building plans and site locations require developer approval before construction.
- Impervious surface limit: No more than 3,078 square feet of any lot may be covered by structures or paved surfaces (including walkways, driveways, patios) to comply with North Carolina coastal stormwater regulations.
- Fences, signs & satellite dishes: Fences require written approval and cannot be placed nearer the front lot line than the rear corner of the house. No satellite dishes are allowed. Only one 'For Sale' sign (max 5 sq ft) is permitted on improved lots. No yard sales or garage sales.
- Vehicles & parking: Off-street parking for at least two cars must be provided on each lot, with driveways and parking areas made of concrete, asphalt, brick, or landscape paving blocks. Boats must not be visible from the street. Inoperative or unlicensed cars cannot be kept on the property.
- Pets & animals: No domesticated farm animals or fowls are allowed. Kennels or pet facilities are prohibited in front or side yards.
- Maintenance obligations: Lot owners must keep their lot mowed, maintain drainage ditches, and keep garbage receptacles out of street view except on pickup days. The developer may enter and clean up at the owner's expense if rules are breached.
