What South Oleander's governing documents say
South Oleander, Section E is a single-family home subdivision in Wilmington, NC, governed by a 1967 Declaration of Restrictions. These rules apply to all lot owners in the subdivision and are designed to maintain a uniform residential character.
- Residential use only: Lots may be used only for residential purposes. Only one detached single-family dwelling (max 2.5 stories) plus a one- or two-car garage is allowed per lot.
- Setbacks & lot size: Buildings must be at least 50 feet from the front street line and 15 feet from adjacent property lines. Lots cannot be re-subdivided unless the subdivided part merges with another whole lot.
- Minimum square footage & materials: Every dwelling must have at least 2,000 square feet of interior area (excluding porches and garages). Exterior materials are limited to wood, brick, brick veneer, tile and stucco, or concrete and stucco; garages must match the dwelling's materials.
- Architectural review: Building designs must be approved by the developer or a committee. The reviewer has 10 days to act; if no response, approval is not required as long as the design is in harmony with existing structures.
- Prohibited structures: No trailer, basement, tent, shack, garage, barn, or other outbuilding may be used as a residence.
- Drainage responsibility: If the subdivision lacks gutters and curbstones, each owner must install and maintain a culvert or drainage pipe under their driveway to maintain natural drainage flow.
- Enforcement: Any property owner in the subdivision can sue to enforce these restrictions or recover damages for violations.
- What this document doesn't cover: This declaration does not address HOA fees, assessments, leasing restrictions, pet rules, parking, or any common amenities. It is a standalone set of covenants, not a full HOA rulebook.
