The Village at Churchill is a townhome community in Wilmington, NC, governed by a homeowners association (HOA). Each owner owns a lot and a townhouse unit, and the HOA maintains common areas and exterior building surfaces. This document is the full declaration of covenants, conditions, and restrictions (CC&Rs) that run with the land.
- What you own & maintain: You own your lot and townhouse unit. The HOA maintains the exterior of each unit (roofs, gutters, paint, decks, landscaping) and all common areas, including roads, walkways, and amenities. You are responsible for interior maintenance and your own casualty/liability insurance.
- Assessments & fees: Annual assessments are levied per lot, initially capped at $1,100 per year, with annual increases up to 5% without a membership vote. A working capital assessment equal to two months' common expenses is due at closing. Special assessments for capital improvements may also be levied. Delinquent assessments accrue 18% annual interest and become a lien on the property.
- Leasing & rentals: Leases must be for a term of at least six months. The HOA may recommend rental agents but cannot control rental periods or fees. Owners have the right to rent their units directly, subject to the declaration and HOA rules.
- Occupancy limits: No more than four unrelated occupants and no more than six total occupants per lot.
- Architectural review: All exterior changes (buildings, fences, paint colors, satellite dishes, antennas, clotheslines) require prior written approval from the HOA's architectural committee or board. Plans are deemed approved if not acted on within 30 days of submission.
- Parking & vehicles: Inoperable vehicles or those without current registration and insurance are prohibited and may be towed. Boats, campers, trailers, and mobile homes are not allowed on lots or common areas.
