Lincoln Forest is a single-family home subdivision in Wilmington, NC. These restrictions apply to all lots in Section B and are binding on current and future owners. The document sets rules for residential use, building size and placement, and architectural approval.
- Residential use only: All lots must be used for residential purposes only. No noxious or offensive trades or activities are allowed.
- Single-family dwellings: Only one detached single-family dwelling (max 2.5 stories) and a private garage for up to 3 cars may be built per lot. No trailers, tents, shacks, or outbuildings may be used as residences before the main house is built.
- Minimum size & materials: Each dwelling must have at least 1,200 square feet of interior floor area. Exterior materials must be wood, brick, brick veneer, tile and stucco, or concrete and stucco; garages must match the dwelling's materials.
- Setback requirements: No building may be located closer than 50 feet to the front street line or closer than 10 feet to an adjacent property line.
- Architectural review: Building designs must be approved by The Oleander Company (Hugh MacRae II acts for the company). The company has 10 days to approve or disapprove plans after a written request; if no response within 10 days, approval is not required as long as the design is in harmony with existing structures and complies with restrictions.
- Lot subdivision: No lot may be re-subdivided unless the subdivided part becomes part of a whole lot and the remainder becomes part of another whole lot.
- Duration & amendment: These covenants were binding until October 1, 1983, and automatically extend for successive 10-year periods unless a majority of lot owners vote to change them.
- Enforcement: Any lot owner in the subdivision may sue to enforce these restrictions or recover damages for violations.
