Churchill Estates High Density is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land. These rules apply to all lot owners in Section 1 and are enforced by the Churchill Estates Homeowners Association.
- Land use & building type: Lots are restricted to single-family residential use only. Each lot may have one detached single-family dwelling with a garage for no more than two cars; garage apartments are prohibited.
- Architectural review: Building plans must be approved by the developer (or successor) before construction. If no response is received within 20 days of submission, plans are deemed approved as long as they conform to the general character of the subdivision.
- Setbacks & building lines: Structures must be at least 25 feet from the front street line and 10 feet from side lot lines. Detached garages or storage buildings may be as close as 5 feet to side or rear lines. Eaves may overhang up to 3 feet; uncovered stoops, patios, decks, and steps are allowed within setbacks.
- Pets: Only domesticated dogs, cats, or other household pets are allowed. They may not be kept for commercial purposes or in numbers that become a nuisance.
- Vehicles & storage: Inoperative junk cars and unsightly vehicles are prohibited. No house trailers, mobile homes, modular homes, prefabricated homes, tents, shacks, or temporary structures may be used as residences.
- Fences: Fences require developer approval for type, quality, height, and installation. They cannot be placed nearer the front lot line than the front corners of the house, except for wrought iron, brick, or other ornamental fences with written consent.
- Signs: Only 'For Sale' or 'For Rent' signs are allowed, and they must not exceed six square feet.
- Homeowners association & assessments: All lot owners automatically become members of the Churchill Estates Homeowners Association and must pay dues and assessments as provided in the Association's By-Laws. The Association is responsible for maintaining common areas and open spaces (though none exist in Section 1).
