Mayfaire Townview Condominium is a second-tier condominium community within the larger Mayfaire planned community in Wilmington, NC. You own your individual unit and a share of the common elements, but the property is also subject to a master association and a first-tier condominium association, meaning you'll pay assessments to multiple entities. This document establishes the condominium regime and sets rules for owners, tenants, and guests.
- What you own & maintain: You own the interior of your unit, including HVAC equipment serving only your unit. The association maintains the common elements (lobbies, stairwells, corridors, elevators) and limited common elements like balconies and assigned storage spaces, but repair costs for limited common elements are assessed to the benefiting unit.
- Leasing & rentals: Leases must be in writing and have a term of at least three months, except for leases to bona fide contract purchasers. Owners must provide tenant names and contact info to the association and give tenants a copy of the declaration and rules.
- Pets: A maximum of two small common household pets (not exceeding 35 lbs or 18 inches in height) are allowed per unit. Pets must be leashed or carried on common elements, cannot be left unattended, and must be registered with the association. The association may further restrict pet ownership.
- Use restrictions: Units are for residential use only, with limited home office use allowed (no customers visiting, no business address advertised). No timeshares, no hazardous substances beyond normal household use, and no nuisances (odors, noise, etc.).
- Signs: No signs or advertising devices on the exterior of units or common elements, except for developer signs during the development period. Neon signs are prohibited.
- Assessments & fees: Common expenses are apportioned equally among all units. Owners also must pay assessments to the master association (Mayfaire Community Association) and the first-tier association (Mayfaire BG Condominium Owners Association).
- Development rights: The developer reserves the right for 40 years to add up to 164 additional units (max 200 total) and to create parking deck easements, without owner consent. Additional units may differ in style and quality.
