What The Commons's governing documents say
The Commons, Section 4 is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions recorded in 1995. These rules apply to all lot owners and are designed to maintain a residential character and property values through architectural controls and use restrictions.
- Residential use only: All lots must be used for residential purposes only. The developer may maintain model homes or sales offices.
- Minimum home size: Each residence must have at least 1,400 square feet of heated living area.
- Architectural review: An Architectural Control Committee must approve all buildings, fences, walls, pools, antennas, and other structures, including exterior design, materials, colors, and landscaping. Plans not acted on within 30 days are deemed approved.
- Construction standards: Exterior materials must be wood, brick, masonite, vinyl, or composition board (concrete block requires brick veneer). Roofs must have strong, varied lines; no flat roofs. Exterior construction must be completed within 8 months.
- Pets: Only normal household pets are allowed, and they must be kept under the owner's control at all times.
- Parking & vehicles: No unregistered vehicles. Only standard two-ton pickup trucks or smaller may be parked overnight on lots or streets. No commercial vehicles overnight. Motorcycles, campers, trailers, boats, and RVs must be stored in the rear of the lot and screened from view.
- Fences & landscaping: Fences must be wood (no wire or chain link) and approved by the Architectural Control Committee. All lots must be fully landscaped within 30 days of certificate of occupancy, with plans approved by the committee.
- Signs: One 'For Sale' sign of no more than 5 square feet is allowed on a completed residence. No other signs are permitted except developer signs and contractor signs approved by the committee.
