What Highland Hills's governing documents say
Highland Hills is a single-family home subdivision in Wilmington, NC, governed by restrictive covenants that run with the land. These rules apply to all homeowners in Section 10A and are designed to maintain a residential neighborhood.
- Residential use only: All lots must be used exclusively for residential purposes. No commercial or business activity is allowed.
- Single-family homes only: Only one detached single-family dwelling, not exceeding 2½ stories, plus a one- or two-car garage, may be built on each lot.
- Minimum square footage: Each residence must contain at least 2,000 square feet of living area.
- Architectural review: Plans and specifications for any building must be approved by the developer or their successors or assigns.
- No temporary housing: No trailer, basement, tent, shack, garage, barn, or other outbuilding may be used as a residence, temporarily or permanently.
- Nuisance prohibition: No noxious or offensive trade or activity may be carried on, nor any use that becomes an annoyance or nuisance to the neighborhood.
- Covenant duration and amendment: These covenants run with the land until January 1, 1988, and automatically extend for successive 10-year periods unless a majority of lot owners votes to change them.
- What this document doesn't cover: This document does not address pets, leasing, parking, assessments, or an association. It is a set of restrictive covenants from the original developer, not a full HOA rulebook.
