What Oleander Court Condominiums's governing documents say
Oleander Court Condominiums is a 92-unit condominium community in Wilmington, NC, established in 1983. You own your individual unit and an undivided interest in the common areas, which are maintained by the Oleander Court Homeowners Association. This document is the original Declaration of Condominium that sets up the legal framework for the community.
- What you own & maintain: You own the interior of your unit, including non-load-bearing walls, interior finishes, windows, exterior doors, and in-unit utility lines. You are responsible for maintaining all interior surfaces, appliances, HVAC equipment, and fixtures. The Association maintains the common areas, including roofs, foundations, exterior walls, stairways, parking areas, sidewalks, and utility infrastructure serving multiple units.
- Use restrictions: Units are restricted to single-family residential use only. No transient hotel or commercial use is allowed. No immoral, offensive, or unlawful use is permitted. Owners must not create nuisances or interfere with other owners' peaceful enjoyment.
- Structural & exterior alterations: No structural modifications or alterations to a unit are allowed without prior written consent of the Association. No exterior changes (including painting, antennas, or air conditioning units protruding through walls or roof) are permitted without Association approval. No objects may be affixed to common areas or landscaping changed without consent.
- Leasing & rentals: The document does not specify a minimum lease term or any rental restrictions beyond the general prohibition on transient use. Leases are permitted but must comply with the single-family residential use restriction.
- Pets: The document does not address pet ownership or restrictions.
- Assessments & common expenses: Common expenses are shared by unit owners in proportion to their undivided interest in the common areas (percentages listed for each unit, ranging from 1% to 1.3%). The Association may levy assessments for common expenses, including a capital reserve. Special assessments may be levied for costs caused by a unit owner's negligence.
- Insurance: The Association must carry property insurance on all buildings and improvements (fire, extended coverage, vandalism) and public liability insurance. Premiums are a common expense. Unit owners may obtain their own insurance for their unit and personal property.
- What this document doesn't cover: This document does not include rules on pets, minimum lease terms, parking assignments, age restrictions, or specific architectural review procedures. Those may be addressed in the Association's By-Laws or Rules and Regulations.
