SeaSpray Landing is a single-family home subdivision in Wilmington, NC, governed by a homeowners' association (HOA). The rules apply to all lot owners, residents, and guests, and are designed to protect property values and maintain a uniform residential character.
- What you own & maintain: You own your lot and the dwelling on it. The HOA maintains common areas (e.g., open space, drainage systems, roadways) and also handles exterior maintenance of your home (painting, roofing, siding, etc.) except for interior surfaces. You must maintain your own landscaping and interior.
- Architectural review: All exterior changes—including new construction, additions, painting, fences, and landscaping—require prior written approval from the Declarant or an Architectural Control Committee. Plans are reviewed for harmony of design and location. Approval is deemed given if no response within 30 days.
- Building & lot standards: Only single-family dwellings are allowed. Minimum enclosed dwelling area is 1,400 square feet (excluding garages, decks, porches). No more than 3,000 square feet of impervious surface per lot. Dwellings must be completed within 12 months of starting construction. No temporary structures as residences.
- Pets & animals: Dogs, cats, and other household pets are allowed but not for commercial purposes. They must be leashed and not run free. Livestock and poultry are prohibited.
- Parking & vehicles: Each lot must provide off-street parking for at least 4 cars. No inoperable vehicles, vehicles without current registration/insurance, or tractor-trailers are allowed. Vehicle repairs must be done inside garages and not visible from the street. Boats, campers, and recreational vehicles require written consent to be stored on the lot.
- Leasing & rentals: The document does not restrict leasing terms or require HOA approval for rentals. However, tenants must comply with all covenants.
- Assessments & fees: Annual assessments are set by the Board and can increase up to 5% per year without a vote; higher increases require 2/3 member approval. Special assessments for capital improvements also require 2/3 vote. A working capital assessment equal to two months' dues is due at closing. Assessments are a lien on the property.
- Signs & exterior appearance: Signs (including for-sale/rent signs) require written permission, except legal notices. Window coverings visible from outside must be white or neutral. Exterior lights must be clear, white, non-frost, or yellow bug bulbs. No satellite dishes or outside antennas without Board approval.
