What Windemere's governing documents say
Windemere is a single-family home subdivision in Wilmington, NC, governed by a Declaration of Restrictions that runs with the land. These rules apply to all lot owners and are designed to maintain the community's residential character and attractiveness.
- Residential use only: All lots are for single-family residential use only. No business may be conducted from a residence if there is any outward evidence (signs, commercial vehicles, materials stored outside, etc.).
- Building & setback requirements: Only one detached single-family dwelling (max 2.5 stories) and a private garage for up to 3 cars are allowed. Minimum floor area is 1,850 sq ft (excluding porches, garages, etc.). Setbacks: 50 ft from front, 10 ft from sides, 25 ft from rear. Unattached garages must be at least 75 ft from front and 5 ft from sides/rear.
- Construction timeline: A structure must not remain unfinished for more than six months after the foundation is laid (unless the exterior is finished). Purchasers must build a residence within three years of buying from the developer, or the developer may repurchase the lot.
- Nuisances & maintenance: No noxious or offensive trades, no farm animals or fowl, and no unsightly inoperative junk cars or eyesores. Yards must be properly maintained at the owner's expense.
- Fences: No fence may be placed beyond the front of the residence unless it is ornamental in nature.
- Water & drainage: Water for human consumption must come from the community water system unless approved otherwise. Each owner must install and maintain a culvert or drainage pipe (min 12-inch diameter, 18 ft long) under their driveway, with masonry retaining walls, to prevent blocking natural drainage.
- Architectural review: Building designs must be approved by the developer (or their appointee). The developer has 10 days to approve or disapprove plans; if no response within 10 days, approval is not required as long as the design is in harmony with existing structures.
- Sanitation association & assessments: All lot owners automatically become members of the Windemere Sanitation Association, which operates and maintains the sewage collection and disposal system. The association may levy annual and special assessments (with limits: annual increases up to 10% without membership vote; special assessments require 2/3 vote). Assessments are a lien on the lot and a personal obligation of the owner.
