West Wood at Echo is a townhome community in Wilmington, NC, governed by a homeowners association (HOA). Each owner owns a lot and living unit, with shared common areas and party walls. The HOA handles exterior maintenance (except doors, windows, decks, and landscaping in rear courtyards) and enforces use restrictions.
- What you own & maintain: You own your lot and living unit. The HOA maintains roofs, gutters, exterior surfaces, trees, shrubs, grass, walks, and other exterior improvements, but not doors, windows, screens, frames, rear decks, skylights, or landscaping inside rear courtyards.
- Architectural review: Any exterior changes (buildings, fences, landscaping, tree removal) require written approval from the HOA Board or an Architectural Review Committee. Plans are deemed approved if no decision is made within 30 days.
- Party walls: Walls on dividing lines between lots are party walls. Repair and maintenance costs are shared proportionally by owners who use the wall. Disputes are resolved by arbitration.
- Use restrictions: Lots are for residential use only. No nuisances, junk vehicles, temporary structures, recreational vehicles (boats, campers, trailers), or for-sale signs (except by developer). Pets (dogs, cats) are allowed but must be leashed and not a nuisance. No outside antennas without approval. Window coverings visible from outside must be white or neutral. - Insurance: The HOA carries liability insurance on common areas (at least $1,000,000). Each owner must maintain a homeowner's policy (Form 3 or better) and, if in a flood zone, flood insurance, covering 100% replacement cost. The HOA must be listed as an additional interest.
