What Arboretum Village Townhomes's governing documents say
Arboretum Village Townhomes is a planned community of 98 townhome lots in Wilmington, NC, governed by a homeowners association. Each owner holds fee simple title to a lot and a townhome unit, and the association maintains common elements and provides exterior maintenance and master insurance for the townhome buildings.
- What you own & maintain: You own your lot and townhome unit. The association handles scheduled exterior maintenance (repainting, roof replacement, gutters) but not windows, exterior doors, decks, or HVAC. You are responsible for interior maintenance, exterior doors, windows, porches, patios, screens, HVAC, and exterior light fixtures.
- Assessments & fees: Annual assessments are set by the board and may be paid in installments. A working capital assessment equal to two months' assessments is due at purchase. Special assessments for capital improvements require a 2/3 vote. Assessments are a lien on the lot; unpaid assessments accrue 18% annual interest.
- Use restrictions: Lots are for residential use only, with one single-family townhome per lot. No lot may be subdivided. During the declarant control period, the declarant may use lots for sales offices or models.
- Architectural review: No exterior structures, additions, or alterations may be made without written approval from the board or an architectural committee. Plans are deemed approved if not acted on within 30 days of submission.
- Insurance: The association carries property insurance on townhome buildings at 100% replacement cost. Each owner must maintain liability insurance of at least $100,000 per occurrence and may insure personal property. Insurance deductibles are allocated based on the loss: common expenses for limited common elements, owner-paid for unit damage.
- Easements & entry: The association has easements to enter lots for maintenance, inspections, and emergencies. Utility easements exist for sewer, water, gas, electricity, telephone, cable, and communication lines. Emergency services have access to all lots and common elements.
