Otter Creek Estates, Section 2 is a single-family home subdivision in Wilmington, NC, governed by a homeowners association (HOA). The rules apply to lot owners and are designed to maintain an attractive residential community with specific architectural and use standards.
- Property use & restrictions: All lots are for single-family residential use only. No business, trade, or occupation may be conducted on any lot. No house trailers, mobile homes, tents, or temporary structures may be used as residences.
- Building & architectural standards: Dwellings must be at least 1,500 square feet (exterior foundation, excluding porches, garages, etc.), no more than two living levels, and no taller than 40 feet. Exterior siding must be wood (or similar texture) in earth tones, with semi-transparent stain or natural wood. Shingles must match Otter Creek Landing Condominiums. Plans must be approved by the Declarant or later by an architectural review committee.
- Setbacks & lot lines: Buildings must be at least 10 feet from the front property line and 7.5 feet from side boundaries. On corner lots, the side with less street frontage is considered the front. Owners of contiguous lots may combine them for one residence, ignoring interior boundary lines.
- Fences & signs: Fences must be wood or chain link, and cannot be placed nearer the front street line than the rear corners of the house. Chain link dog runs are allowed only if completely within a wooden fence. Signs are limited to private name plates of no more than 1 square foot.
- Vehicles & storage: No inoperative junk cars or unsightly eyesores may be kept on any lot. Yards must be properly maintained; if not, the HOA may clean up at the owner's expense and place a lien on the property.
- Animals: No domesticated farm animals or fowls may be kept on the property.
- Drainage & utilities: Owners must install and maintain adequate culverts or drain pipes under driveways to prevent blocking natural drainage. The Declarant retains easements for utilities (electric, telephone, water, sewer, etc.) along the rear 5 feet, front 10 feet, and one side 7.5 feet of each lot.
- Assessments & HOA fees: The HOA (Otter Creek Estates 2 Homeowners Association) may levy annual and special assessments for common expenses, including private street maintenance. Assessments are equal for all lots (except special assessments for streets used only by certain owners). Unpaid assessments accrue 12% annual interest and become a lien on the lot; the HOA may sue or foreclose.
