Harbour Point is a single-family townhome community in Wilmington, NC, governed by a homeowners' association (HOA). The declaration of covenants, conditions, and restrictions (CC&Rs) applies to all lot owners, who are automatically members of the HOA. The HOA maintains common areas, limited common areas (exteriors of dwellings), and designated common areas (yards adjacent to each lot), and has the authority to levy assessments and enforce rules.
- What you own & maintain: You own your lot and the townhome on it. The HOA maintains the exterior of your dwelling (roof, siding, decks, porches, gutters) as 'limited common area,' but not HVAC systems. You are responsible for the interior and for maintaining the designated common area (yard) behind any privacy fence.
- Assessments & fees: Annual assessments are set by the board each year. Special assessments for capital improvements, insurance assessments, and ad valorem tax assessments may also be levied. A one-time working capital assessment of $200 is due when a lot is conveyed to a retail purchaser. Assessments are a lien on the lot and a personal obligation of the owner.
- Architectural review: Any exterior changes (including painting, fences, or new structures) require prior written approval from the Declarant, the Board, or an Architectural Control Committee. Plans are reviewed for harmony of design and location; approval may be withheld for any reason, including aesthetics. If no decision is made within 30 days, approval is deemed given.
- Use restrictions: Lots are for residential use only, with one single-family townhome per lot. Minimum dwelling size is 1,600 square feet (1,400 with committee approval). No temporary structures, trailers, or tents may be used as residences. No noxious or offensive activities are allowed. Clotheslines are prohibited in designated common areas.
- Parking & vehicles: At least one off-street parking space must be provided per lot, constructed of concrete, brick, asphalt, or turf stone (or other approved material).
- Insurance: The HOA must maintain casualty and liability insurance for the common areas and limited common areas, with at least $1,000,000 in liability coverage. Individual lot owners may be required to obtain their own policies if two-thirds of members vote to switch from a master policy.
- Developer rights: The developer (Declarant) retains special rights, including the ability to amend the declaration without member approval in certain cases, annex additional property, and control the architectural review committee until all lots are sold or by December 31, 2005. The developer holds three votes per lot owned (Class B membership) until that control period ends.
