Otter Creek Landing is a condominium community in Wilmington, NC, with a private boat dock facility. Membership in the Otter Creek Landing Yacht Club is mandatory for all unit owners and includes rights to use the boat slips and common areas. This document governs the yacht club membership, assessments, and use of the dock facilities.
- Membership & boat slips: Every condominium unit owner automatically becomes a member of the Yacht Club. Each membership may be assigned a boat slip by the Association. Boat slips cannot be sold or transferred separately from the condominium unit.
- Leasing & rentals: Condominium units may be rented, but a boat slip cannot be leased separately from the unit. Timesharing or interval ownership of memberships or property is prohibited.
- Assessments & fees: The Association levies annual assessments and may levy special assessments for capital improvements (approved by two-thirds of voting members). Assessments are a lien on the membership and bear 10% annual interest if delinquent. Declarant is exempt from assessments for 60 days after the first unit deed.
- Use restrictions: No commercial use of the properties, common areas, or boat slips is allowed (except Declarant's marketing). Houseboats may not remain in a slip over 48 hours without Board approval. Cleaning fish in the harbor is prohibited. Boats must not extend beyond their slip or exceed the designated length.
- Architectural review: No structures (buildings, fences, walls, signs) may be erected or altered on common areas without written approval from the Board or an architectural committee. Dock boxes are limited to one per slip, subject to Board approval of size, design, and location.
- Enforcement & duration: The Association or any member may enforce the covenants. The declaration runs for 25 years from recording (1983), with automatic 10-year extensions. Amendments require a two-thirds vote of all members.
